Summary of the Daf

1.   If someone rents a house to his friend the renter must put up the Mezuzos and he may not take the Mezuzos with him when he leaves the house.

2.   If he rents the house from a non-Jew he may take the Mezuzos with him when he leaves.

3.   If someone rents a house without the courtyard the fertilizer that is produced from oxen that trespass in the courtyard belongs to the owner of the courtyard because a courtyard is Koneh without the Da’as of the owner.

4.   If someone says my courtyard shall be Koneh all of the lost objects that enter my property today if the courtyard is not guarded it is not Koneh the lost objects.

5.   If there is a Kol that a specific lost object entered his courtyard his courtyard and he says my courtyard shall be Koneh the Metziah it is Koneh even though it is not guarded.

6.   Fertilizer that is produced by his oven belongs to the renter and fertilizer that the renter catches out of the air of the courtyard belongs to him even though he rented only the house and not the courtyard.

7.   Abaye says the renter is Koneh the fertilizer only if he catches it immediately before it enters the airspace of the courtyard, while Rava says since he caught it in a utensil the airspace of the owner of the courtyard is not Koneh.

8.   If someone is Mafkir his purse and throws into the entrance of his friend’s courtyard and it exits out of the other entrance it is a Safek if the courtyard is Koneh the purse of his friend.

9.   If someone rents a Stam courtyard to his friend if there is a barn on the courtyard it is not included in the rental and therefore the fertilizer in the barn belongs to the owner.

10.   The Chiyuv of Shilu’ach ha’Kan applies to birds which nest in the bird coop or the attic and it is forbidden to steal the birds because of Darkei Shalom.

11.   The Chiyuv of Shilu’ach ha’Kan only applies if it is not Mezuman.

12.   When an egg is mostly hatched the Chiyuv of Shilu’ach ha’Kan applies.

13.It is forbidden to be Zocheh in the eggs while the mother is hovering over them.

14.   If someone rents a house to his friend for a year if the year is made into a leap year the renter may stay an extra month without paying extra.

15.   If he rents the house per month if the year is made into a leap year the renter must pay for the extra month.

16.   If the house was rented for twelve gold pieces for the year and one gold piece per month the renter pays for half of the extra month.

17.   Shmuel says he pays half of the rent only if the owner collects the rent in the middle of the month but if he collects the rent at the end of the month the renter doesn’t pay for the extra month at all and if he collects it at the beginning of the month he must pay for the whole month.

18.   R. Nachman says even if he collects at the end of the month the renter must pay in full for the extra month because the house is in the Chazakah of the owner.

19.   Rav says that if someone sells an object to his friend for an Istira- one hundred Ma’ah he must pay a hundred Ma’ah but if he says a hundred Ma’ah- an Istira he must pay an Istira because the last Lashon that he used is the primary Lashon.

20.   Rav and Shmuel both agree that if someone tells his friend I am selling a Kor of grain for thirty Zuz they may back out until the last Se’ah changed hands because it is one big purchase.

21.   If sells a Kor for thirty Zuz and each Se’ah for a Sela he is Koneh each Se’ah when it exchanges hands and he may not back out.

22.   If a father dies within thirty days of the birth of his Bechor it is a Chazakah that he didn’t redeem his son and the son must redeem himself and give five Sela’im to the Kohen.

23.   If the father died after the Bechor is thirty days old it is a Chazakah that he redeemed his son unless he is told that his father did not yet redeem him.

You may think, how does one little Mitzvo help . . .

Our times are calling out to us to do Teshuva, but it’s too hard for us to change our lives. Even when we try, we end up reverting back to nothing, everything as was. We MUST show HaShem that we are seeing the signs and that it means something to us.

In this way, when HaShem asks what did we did, we can reply “I took this on…”

You must not consider this “Little Mitzvos” as a replacement for the Shulchan Oruch – you must continue learning Halochos via mainstream Seforim and with Shiurim.

Brochos

Ensure your hands are clean before saying a Bracha (eg, after cleaning child’s diaper).

Rav Yisroel Yaakov Fisher – When Your Parents Are Beyond Their Bounds

The only exclusion written in Shulchan Aruch, not to listen to your parent is if their wishes go against a mitzva, minhag, or shidduch. What happens if your parents tell you to do something that is not for their benefit, must you listen to what they say?

Rav Yisroel Yaakov Fisher (Even Yisroel 9:87:4) brings the Rashba in Yevamos that says that the mitzva of Kibud or honoring, only covers things that physically benefit the parent such as giving them to eat and drink. However the Makneh says in Kiddushin that even when there is no mitzva of Kibud, you still need to listen to your parents because there is a mitzva of Morah, fear. This includes not contradicting there words.

However says Rav Fisher, this issur of contradicting your parents words are only in front of them. Therefore if they insist that you do something that is not relevant to them but only to you, you may not contradict them in their presence, but you may go ahead afterward and do as you see fit to suit your own interests.

If so why does the Shulchan Aruch not says this and only say you need not listen if they go against halacha or minhag? Rav Fisher says because in that case there is no issur to not obey them even in their direct presence. However for matters relevant only to you, you may not contradict them in their presence.

The Tefila On The Tefila

We stand before the King of all Kings in a private audience during Shemoneh Esrei. It is going really well and we leave Hashem with a long list of things we want including the most beautiful of all Brachos, the bracha of Shalom. We finish the audience and we realize that Hashem would love to fulfill all of our requests.

The problem is that it is also up to us not to contradict what we claim are our foremost desires. Lashon Hara is not exactly something that is spoken by a person who truly desires to lead a peaceful and harmonious life with those around him.

Mar Bar Ravina understood this. He therefore composed a Tefila (see Brachos 17a) to say immediately after we finish saying the Bracha of Shalom. “Elokai Netzor Lishoni Meira….”. Hashem guard my tongue from evil and my lips from deceit. To those who curse me, let me remain silent…

No doubt that one who says this with great Kavana will have his wishes for peace fulfilled!

“Zachor Eis Asher Asa Hashem L’Miriam BaDerech B’Tzaischem MiMitzrayim”

The Ramban and other Rishonim count, among the Mitzvos Aseh Min HaTorah, the mitzva of remembering and saying with your mouth each day what Hashem did to Miriam when she spoke about her brother Moshe. The Chofetz Chaim in Shaar Tvunah Perek 12 says that being Mikayem this mitzva can save you from the aveira of Lashon Hara. More than just saying the pasuk, says the Chofetz Chaim, one must think about the incident in order for it to have its intended effect.

5.     WINNING WORDS

When I see an improper sight and turn away, I will tell myself, “I am turning away because Hashem wants me to be pure and holy.”

6.     FEEL GOOD

Each time you turn away from an improper sight, pat yourself on the back and tell yourself, “I am doing great.”

7.     PRAY

When you turn away from an improper sight, it becomes a time when Hashem will answer your prayers. Pray for whatever you want.

8.     PRAY FOR YOUR FRIENDS

The stronger the community is, the stronger I will become. Therefore, if you pray for others, Hashem will strengthen you. Also, as the Gemara says (Baba Kama 92a) one who davens for his friend and he needs the same thing, he is answered first.

Basic explanation of the soul

–  Meaning, we have to identify the essence of a person.
–   It is not his body parts, since he can live without many of them, or receive a transplant.
–   It is not his brain, since this only holds information. Theoretically a person’s collective memories can be uploaded and programmed into a fresh brain of a clone.

–   Basically a person is his conscience awareness, his soul.
–   Although this is seemingly centered in the head, it can be moved to other body parts through meditation.
–   There are three basic parts to the soul nefesh, ruach, and neshama.
–   All functions of the actual body, for example, moving and eating are controlled by the nefesh.
–   Emotions stem from the Ruach.
–   Thought is the neshama.
–   All parts of the soul work in unison.
